Please read these Terms and Conditions carefully before engaging the services of Event Zone EMG (“we,” “us,” or “our”) or purchasing tickets or other products from us. By using our services or making a purchase, you (“the Client” or “Ticketholder”) agree to be bound by these terms.
General Service Agreement (for Event Planning & Management)
1. Service Agreement: Event Zone EMG provides event planning and management services as outlined in the agreed-upon proposal or contract. The specific services, timelines, and fees will be detailed in a separate agreement.
2. Vendor Payments:
- Mandatory Full Payment: For all vendors booked and coordinated through Event Zone EMG, the Client is required to make 100% advance payment as per the agreed-upon vendor terms and our payment schedule. This full payment is a prerequisite for securing the vendor’s services.
- Vendor Performance and Payment Adjustments: Event Zone EMG will use its best efforts to ensure vendor performance aligns with the agreed-upon standards. In the event that a vendor, booked through Event Zone EMG, fails to deliver the services as contracted or makes a significant error that negatively impacts the event, Event Zone EMG will liaise with the vendor to address the issue. If a financial adjustment or compensation is deemed appropriate due to the vendor’s mistake, Event Zone EMG will deduct the agreed-upon amount from the vendor’s payment and refund it to the Client. The final determination of the deduction amount will be at the reasonable discretion of Event Zone EMG, considering the severity and impact of the vendor’s error.
3. Client Responsibilities: The Client agrees to provide Event Zone EMG with all necessary information, access, and cooperation required for the successful execution of the event. The Client is responsible for obtaining any necessary permits, licenses, or approvals required for the event, unless explicitly agreed upon in writing as part of Event Zone EMG’s services. The Client is responsible for the conduct of their guests and attendees.
4. Team Member Safety and Conduct: Event Zone EMG is committed to providing a safe and respectful working environment for its team members. Any form of harassment, abuse (verbal, physical, or otherwise), or disrespectful behavior directed towards Event Zone EMG team members by the Client, their representatives, guests, or vendors will not be tolerated. Event Zone EMG reserves the right to cease services immediately, without refund, in the event of such behavior.
5. Event Team Accommodation: For events requiring on-site Event Zone EMG team members for extended periods, the Client agrees to provide a minimum of one (1) dedicated and private room for the event team’s use. This room should be reasonably comfortable and accessible throughout the event duration for the team to rest, coordinate, and store essential items.
6. Payment Terms: Event Zone EMG’s fees and payment schedules will be outlined in the separate proposal or contract. Unless otherwise specified, invoices are due and payable as per the agreed-upon terms. Late payments may be subject to interest charges.
7. Cancellation and Postponement: Cancellation or postponement of the event by the Client will be subject to the terms and conditions outlined in the separate proposal or contract, which may include cancellation fees.
8. Limitation of Liability: Event Zone EMG’s liability for any claims arising out of or in connection with our services shall be limited to the total fees paid by the Client to Event Zone EMG under the relevant agreement. Event Zone EMG shall not be liable for any indirect, consequential, or incidental damages.
9. Force Majeure: Neither party shall be liable for any failure or delay in performance of its obligations under this agreement arising out of or caused by any event beyond the reasonable control of such party, including but not limited to acts of God, natural disasters, war, civil unrest, strikes, or government regulations.
10. Intellectual Property: Any creative concepts, designs, or materials developed by Event Zone EMG for the event shall remain the intellectual property of Event Zone EMG, unless otherwise agreed upon in writing.
Terms and Conditions for Ticket Purchases
11. Ticket Sales are Final: All purchases of tickets and other products are non-refundable and non-exchangeable. All sales are final.
12. Event Changes: Event Zone EMG reserves the right to cancel or reschedule events. In the event of a cancellation, the ticket price will be refunded to the original purchaser.
13. Authorized Purchase: Tickets purchased from unauthorized resellers may be invalid. Purchase tickets only directly from Event Zone EMG through our official website or authorized channels.
14. Compliance with Event Policies: Ticketholders consent to adhere to security procedures and policies in place at the event venue. This may include bag checks, metal detectors, and pat-downs. Failure to comply may result in ejection from the event without refund.
15. Assumption of Risk: The ticket purchaser assumes all risks incidental to the event, including the risk of personal injury or property damage or loss. Event Zone EMG is not responsible for any such incidents.
16. Prohibited Items: Drugs, weapons, and any other items prohibited by the event venue or applicable laws are strictly prohibited at all events.
17. Outside Food and Beverages: Outside food and beverages are not allowed at event venues unless explicitly permitted by the venue management.
18. Ticket Resale Prohibition: Ticket resale is strictly prohibited without the express written consent of Event Zone EMG. Any tickets found to be resold in violation of this term may be invalidated without refund.
19. Violation of Terms: Violation of any of these terms and conditions may result in the confiscation of tickets and ejection from the event without refund.
General Provisions (Applicable to Both Services and Ticket Purchases)
20. Global Services and Governing Law: Event Zone EMG provides services and sells tickets to clients globally. Recognizing the diverse locations of our clientele, the parties agree to work in good faith to resolve any disputes that may arise. In the event of a legal dispute, the parties agree that the laws of India shall govern the interpretation and enforcement of these Terms and Conditions, without regard to its conflict of law provisions. The exclusive jurisdiction for any legal proceedings shall be in the courts located in Indore, Madhya Pradesh, India.
21. Modification of Terms: Event Zone EMG reserves the right to modify these Terms and Conditions at any time without prior notice. The latest version of the Terms and Conditions will be posted on our website. Continued use of our services or purchase of tickets after any changes constitutes acceptance of the updated Terms and Conditions.
22. Entire Agreement: These Terms and Conditions constitute the entire agreement between the Client/Ticketholder and Event Zone EMG and supersede all prior or contemporaneous communications and proposals, whether oral or written.
23. Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
